PORTAL LOCKERS LLC – TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the your (the “User”, “you”) access to and use of locker rental services and locker systems provided by Portal Lockers LLC (“Portal,” “we,” “our,” or “us”) at Operator Events, Venues, and/or partner locations. The owner/operator of the venue or event is referred to as the “Operator.” Operator may manage operations associated with the locker rental.
A binding agreement is formed between you and Portal when you complete a locker reservation, purchase, or use a locker, whether onsite or through digital means. The Operator may facilitate access to the locker services, and may manage the operations and service provisions associated with your locker rental.
The user undertakes to observe the written (handwritten, printed, electronic, or otherwise) and/or oral user instructions concerning the Operator’s equipment and use of any supplied locker systems, lock and combination.
By purchasing, reserving, or using a locker, you agree to these Terms.
1. Agreement & Capacity
This agreement is binding upon use. You represent you have legal capacity or are using services with parental/guardian consent.
2. Nature of Service
Lockers are provided as a temporary convenience. Portal does not take custody of stored items. No bailment relationship is created.
Portal does not guarantee immediate technical support or resolution of locker system issues.
3. User Responsibilities
You are responsible for securing your locker, maintaining access credentials, and removing items before expiration.
4. Prohibited Items
Items may not be kept and/or stored in the Portal locker systems that might constitute a risk and/or nuisance to Portal or Operator, other users, the facility, or the event, including but not limited to illegal items, illegal substances, perishable food items, drinks and liquids, weapons of any kind, toy guns, and all other items that are not permitted entry into the Operator’s Venue and/or Events . Portal or Operator may inspect or remove such items. Portal or Operator are entitled to have items shown to the Operator or its personnel before they are kept in a Portal locker. Items that, in the opinion of Portal or Operator, are hazardous or could cause a nuisance to the Operator, other users, the event, or the site venue, such as explosives, firearms, chemicals, illegal drugs, or perishable goods, may be refused the placing of, destroyed or removed at the user`s expense without the user being entitled to enforce any claim to the items at any time thereafter.
5. Access Rights
Portal or Operator are entitled to open and inspect any locker during use at any time without notice to user. Portal or Operator may examine Items inside of Portal lockers equipment to approve their entry into Portal’s lockers, even if they have been entrusted to us in a sealed bag, backpack, suitcase, or the like. Before using a locker, the user should check whether it is empty, clean, and operating as it should. Should the user find Items, the user will be obliged towards the Operator to hand these to the Operator of the locker system or its personnel.
At any time, the Operator is entitled: 1) To ascertain the identity of the user by means of his/her/their passport, driver’s license, or other means of identification and to make a photocopy thereof; 2) To surrender the Items only at the end of the time limit of the purchased locker rental; 3) Where applicable, to require a sum to be paid by way of administration charges.
6. Payments, Chargebacks & Refunds
All sales are final. No refunds will be offered or given when services are pre-booked and paid for, whether used or not.
Payments are processed via third parties (e.g., Adyen). Portal is not responsible for processor fees.
Chargebacks are handled per processor rules.
7. Rental Period & Unclaimed Property
Locker rentals are specific to a period of time or duration of an Event that is specified at purchase. The Articles must be collected during the indicated opening times and before the time limit for which the locker rental has been agreed to or for which the available services have expired. The Items will be released only after the charges due have been paid in full. Portal’s services are open for access on-site for the time prescribed by Operator’s Venue or Event.
Items Left Behind: Unclaimed items or items left behind may be removed, stored, or disposed of. Portal or Operator may manage unclaimed or lost items. Portal and Operator are not responsible for item recovery and all unclaimed items are considered forfeited upon expiry for of the locker rental period. Items left behind by an individual may be returned to the person who can provide proof of identity and proof of booking the services that match the identity of the individual listed as the customer on the contract. Portal and Operator are discharged from liability toward any person laying claim to property or items in the possession of Portal or Operator if Portal or Operator releases the property to anyone with the correct proof of identity.
8. Limitation of Liability & Assumption of Risk
Portal and Operator are not liable for loss, theft, unauthorized access, outages, infrastructure failures, or misuse of the locker systems.
The user is solely responsible for all items stored within Portal lockers and at no time shall Portal or Operator be deemed to have custody or control over such items. Purchase of a locker rental and/or use of Portal's lockers or services constitutes an assumption of risk from User.
Portal and Operator can never and on no account be held liable for the loss resulting from lock failure, riots, vandalism, weather, services accessed by others, lock combination accessed by others, theft, or failure to collect the Items after use. Portal does not guarantee the security of any locker or its contents or items and user assumes all risk of loss or theft.
Portal and Operator are not liable for loss to the fullest extent permitted by law. Should it be held by the final legal decision that Portal is liable for loss, it will on no account be liable for more than $300.00 USD per incident or the amount paid for the locker rental, whichever is lesser. This reflects a reasonable allocation of risk.
9. Third-Party Systems
Services rely on Keynius and Adyen. No guarantee of uptime. Portal is not responsible for outages, delays, or failures resulting from third-party systems, including but not limited to Keynius and Adyen.
10. Operator Role
Operator may manage operations. Portal is not responsible for actions of Operator or Operator’s partners and affiliates.
11. Infrastructure Dependency
Service depends on Operator infrastructure including but not limited to the provision of power and internet. Portal is not responsible for failures in Operator infrastructure that impact services associated with the locker rental.
12. Data Processing
User data is processed via Keynius (processor). Portal acts as a data controller.
13. Data Use & Sharing
Data is used for service delivery. Data may be shared with Keynius, Adyen, Operator and Operator’s partners as needed.
14. Data Rights
Requests to acquire, modify or remove your user data from the processor and/or controller systems are to be sent via email to team@portallockers.com. Request will be handled within a reasonable timeframe and within 30 days of receipt.
15. SMS Consent
Transactional messages may be sent. To opt out of receiving SMS messages from Portal, Reply STOP to any message received. You can also send an opt out request via email to team@portallockers.com. Request will be handled within a reasonable timeframe and within 30 days of receipt.
16. No Warranties
Services are provided “as is” without warranties.
17. Insurance & No Bailment
No insurance is provided. No bailment relationship is created.
18. Indemnification
You agree to indemnify, defend, and hold harmless Portal, Operator, and their respective affiliates, partners, and personnel for claims arising from use or violations.
19. Governing Law
All agreements concluded by Portal or Operator are governed solely by New York State law. Any dispute in terms of contract, tort, or any other area of the law, arising under or in connection with this agreement or related to any matter which is the subject of the agreement shall be subject to the exclusive jurisdiction of the state and/or federal courts located in New York.
20. Updates
Terms may be updated at any time without notice.
